General
These Terms and Conditions are to be read in conjunction with the RVL Advanced Diagnostic Imaging Subsidy Program Fact Sheet (Fact Sheet).
1. Capitalised terms used in these Terms and Conditions where not defined have the meaning given in the Schedule.
2. By submitting an Application, Applicants agree:
a. to comply with these Terms and Conditions; and
b. that they have read and understood the Fact Sheet.
Applications
3. Applications are invited for nomination of horses who satisfy the Eligibility Criteria for entry into the Program.
4. Applicants must complete the Application Form by either:
a. completing the online version of the Application Form by clicking here; or
b. completing the manual form on request from veterinaryadmin@racingvictoria.net.au.
5. For an Application Form to be considered by RVL it must:
a. be completed in full and have attached to it all necessary documentation including a report from the Referring Veterinarian; and
b. comply with these Terms and Conditions.
6. By submitting an Application, Applicants warrant that the information contained in their Application is true and accurate.
7. Completed Applications must be received by the closing date for Applications, as advertised by RVL on the RVL Website.
8. RVL will, in its absolute discretion, make a determination as to whether to accept an Applicant Horse into the Program.
9. Not every Applicant Horse that meets the Eligibility Criteria will be accepted into the Program. The ultimate decision in relation to which Applicant Horse is accepted into the Program is at the sole discretion of RVL.
By submitting an Application, Applicants consent to RVL using and disclosing the information provided in the Application Form for the purposes of conducting the Program, including reviewing, processing and selecting Applications, undertaking education, promotional and marketing activities, and any other matters connected to or incidental to the Program or related initiatives.
11. Applicants may be contacted by RVL directly for the purpose of Application assessment, validation and due diligence.
12. RVL may, at its discretion, contact a third party named in the Application, or involved in the Application process, including for the avoidance of doubt, the Referring Veterinarian, for the purpose of Application assessment, validation and due diligence.
13. Applicants are responsible for all costs associated with submitting an Application. RVL will not be liable for any loss or damage suffered or incurred by an Applicant in connection with submitting an Application, engagement of the Participating Practice, or participation in the Program.
14. The Program can be suspended or terminated by RVL at any time.
Successful Applications
15. RVL will notify each Applicant if their Application is accepted or rejected. RVL is under no obligation to provide an Applicant with reasons for its decision to accept or reject an Application.
16. Successful Applicants will receive a Confirmation of Acceptance Form:
a. confirming the details of the Participating Practice; and
b. the Services to be provided to the Applicant Horse.
17. Each Applicant will enter into a separate arrangement with the Participating Practice in relation to the provision of the Services to be provided to the Approved Horse. By submitting an Application Form you acknowledge and agree that RVL is not a party to the arrangement between you and the Participating Practice and takes no responsibility for the care or management of an Approved Horse.
18. RVL will provide a subsidy (Subsidy) directly to the Participating Practice for the provision of the Services to an Approved Horse. The amount of the Subsidy provided under the Program will be in accordance with the Fact Sheet and is at the sole discretion of RVL.
19. RVL will not pay any amount directly to you.
20 . RVL will only provide a Subsidy in relation to Approved Horses for which it has issued a Confirmation of Acceptance Form that has not been subsequently amended and rejected by either RVL or the Applicant.
21. You are responsible for payment of all fees to the Participating Practice other than the Subsidy.
Promotion of Program
22. Applicants must not do, or say, anything, or cause anyone to do, or say, anything that may prejudice, or be detrimental to, or cause damage to, the name and reputation of the Program or RVL .
23. RVL will promote and report on the Program through internal and external communication channels, including, but not limited to, online, social media, website publications, advertising, editorials, newsletters, reports and promotional displays.
24. Applicants agree that if their Application is successful, RVL may promote and report on the and upon RVL will supply RVL with photos, which will then become the property of RVL , who may use them for marketing and promotional purposes.
Definitions
In these Terms and Conditions:
Acceptance Notice means a written notice from RVL confirming that an
Applicant means a person who submits an Application
Applicant Horse means the horse the subject of the Application
Application means the submission of a completed Application Form to RVL
Application Form means the Program application form required to be completed and submitted by an Applicant to apply for entry into the Program
Approved Horse means an Applicant Horse that has been accepted into the Program
Confirmation of Acceptance Notice Form means a written notice from RVL
Eligibility Criteria means the eligibility criteria outlined in the Fact Sheet; and
Participating Practice means any one of the three veterinary facilities participating in the Program, being The University of Melbourne Equine Clinic in Werribee, Ballarat Veterinary Practice Equine Clinic, and Goulburn Valley Equine Hospital in Shepparton
Program means the RVL Veterinary Advanced Diagnostic Imaging Subsidy Program
Referring Veterinarian means the Veterinarian who undertakes a lameness examination on an Applicant Horse and refers the Applicant Horse for diagnostic imaging
RVL means Racing Victoria Limited ACN 096 917 930
RVL Website means the RVL website, currently at the URL www.racingvictoria.com.au, in particular the following Program page;
Services means the services to be provided by a Participating Practice as set out in the Fact Sheet
Veterinarian means a veterinarian registered with the Veterinary Practitioners Registration Board of Victoria (or equivalent board in another State or Territory of Australia) and who is a Racing Victoria Permitted Veterinarian
